These Terms of Service ("Terms") govern your use of ArtLog AI, operated by DataWeaveAI Inc. ("we", "us", "our") at artlogai.com. By using the service, you agree to these Terms. If you do not agree, do not use the service.

1. Service Description

ArtLog AI is an AI-powered platform that generates condition reports for art, antiques, and collectibles. You upload photographs of items, and our AI analyzes them to produce professional condition descriptions using museum-standard terminology. The service also generates downloadable PDF reports and batch catalogs.

ArtLog AI is a documentation tool. It does not provide appraisals, valuations, authentication, or insurance assessments. AI-generated condition descriptions should be reviewed by a qualified professional before being relied upon for high-value transactions, insurance claims, or legal proceedings.

2. Eligibility

You must be at least 18 years old to use ArtLog AI. By using the service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account and Access

ArtLog AI does not require account creation. The service identifies your device using a browser fingerprint. You are responsible for maintaining the security of your device and any data associated with your session.

If you create an optional account, you are responsible for keeping your credentials secure. You agree to notify us immediately of any unauthorized access to your account.

4. Free Trial

New users receive 5 free item reports with no signup or payment required. Free trial items are subject to the same terms as paid usage. We reserve the right to modify or discontinue the free trial at any time.

5. Payment Terms

Pricing

ArtLog AI offers the following paid plans:

• Estate Pack — One-time purchase of 100 item reports
• Pro Monthly — Recurring monthly subscription for unlimited items
• Pro Annual — Recurring annual subscription for unlimited items

All prices are listed in US dollars. We reserve the right to change pricing at any time, with notice to existing subscribers before the next billing cycle.

Billing

Payments are processed securely by Stripe, Inc. By making a purchase, you authorize us to charge the payment method you provide. Subscriptions renew automatically at the end of each billing period unless cancelled.

Refunds

We want you to be satisfied with ArtLog AI. Our refund policy is as follows:

• Estate Pack (one-time) — Refundable within 7 days of purchase if fewer than 10 item credits have been used
• Monthly subscriptions — No refunds for partial months. You may cancel at any time and retain access through the end of your current billing period.
• Annual subscriptions — Refundable within 14 days of purchase or renewal if fewer than 20 item reports have been generated during the current period

6. Acceptable Use

You agree to use ArtLog AI only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload illegal, harmful, or obscene content
• Upload content that infringes on any third party's intellectual property rights
• Attempt to reverse-engineer, decompile, or extract the AI models or algorithms
• Use automated scripts, bots, or scrapers to access the service
• Interfere with or disrupt the service's infrastructure or other users' access
• Circumvent usage limits, fingerprint tracking, or payment systems
• Use the service to generate fraudulent condition reports, fake provenance, or deceptive documentation
• Resell or redistribute the service without written permission
• Use the service in any way that violates applicable laws or regulations

7. Intellectual Property

Your Content

You retain full ownership of all photos you upload and all condition reports generated from your content. We do not claim any intellectual property rights over your images or generated reports. You grant us a limited license to process your content solely for the purpose of providing the service (generating condition reports).

Our Service

ArtLog AI, including its design, code, AI models, branding, and documentation, is the intellectual property of DataWeaveAI Inc. You may not copy, modify, distribute, or create derivative works based on our service without written permission.

8. AI-Generated Content

Condition reports are generated by artificial intelligence. While we strive for accuracy using museum-standard terminology, AI-generated content may contain errors, omissions, or inaccuracies. You acknowledge that:

• AI-generated reports are assistive tools, not professional opinions
• Reports should be reviewed and edited by qualified personnel before use in formal contexts
• We are not responsible for decisions made based on AI-generated content
• The AI may not detect all condition issues, especially those not visible in photographs

9. Data and Privacy

Your use of ArtLog AI is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Key points:

• Uploaded photos are automatically deleted within 24 hours
• We use browser fingerprinting, not cookies, for session management
• Photos are processed by the Anthropic Claude AI API
• We do not sell your data to third parties

10. Service Availability

We aim to provide reliable, uninterrupted access to ArtLog AI, but we do not guarantee 100% uptime. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by service downtime.

11. Limitation of Liability

To the maximum extent permitted by law:

• ArtLog AI is provided "as is" and "as available" without warranties of any kind, express or implied
• We disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service
• Our total liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not responsible for the accuracy, completeness, or reliability of AI-generated condition reports

12. Indemnification

You agree to indemnify and hold harmless DataWeaveAI Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to ArtLog AI at any time, with or without cause, including for violation of these Terms. Upon termination:

• Your right to use the service ceases immediately
• We may delete data associated with your session or account
• Active subscriptions will not be renewed, but no refund is owed for the current period unless otherwise required by law

You may stop using the service at any time. To cancel a subscription, email joseph@dataweaveai.com or manage your subscription through the app.

14. Modifications to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the service after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify users (via email or in-app notice).

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall be resolved in the state or federal courts located in Delaware.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DataWeaveAI Inc. regarding your use of ArtLog AI, and supersede any prior agreements.
